Terms of Use
Effective Date: September 30th, 2025
In these Terms of Use, Sunday Pro Inc. d/b/a Loqol and its affiliates are referred to as “Loqol,” “we,” and “our.” These Terms of Use govern your use of Loqol’s websites; mobile and messaging experiences (including iMessage, WhatsApp, SMS); online content, digital products, and services; software applications and platforms; and any other Loqol products and services (collectively, the “Services”). Some Services may include software downloaded to your device and may be automatically updated; these Terms apply to all updates. Please read carefully and contact us if you have questions.
1) This is a Binding Contract
By creating an account, checking a box, tapping “Agree,” or using the Services, you enter a legally binding contract with Loqol (these “Terms”), even if you are using the Services on behalf of a company or other entity. If you do not agree, do not use the Services.
2) Changes to the Terms
We may modify these Terms or add terms at any time. If changes materially affect your experience, we will provide notice via the Services or other reasonable means so you can review them before they take effect. Your continued use of the Services after changes become effective constitutes acceptance. If you do not agree, you must stop using the Services.
3) Who May Use the Services
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you use the Services on behalf of an organization, you represent you have authority to bind that organization to these Terms.
Real-estate compliance notice (U.S.): You are responsible for ensuring your use of the Services complies with applicable federal, state, and local laws, MLS rules and policies, fair housing laws, advertising rules, and any brokerage-specific policies.
4) Your Account
You agree to: (a) provide accurate, current information; (b) keep your credentials secure; (c) not share or transfer your account; and (d) promptly update information as needed. You are responsible for activity under your account.
Communications. You consent to receive notices and messages from Loqol via the Services and to the contact methods you provide (email, phone, SMS/iMessage/WhatsApp). Message and data rates may apply. You may unsubscribe from non-transactional emails via the included links; certain transactional or legal notices may still be sent.
Payments. If you purchase paid Services (e.g., flat-fee MLS listing), you agree to pay the displayed fees and taxes and to the payment/refund terms presented at checkout.
5) Privacy
Our Privacy Policy describes how we collect, use, disclose, and protect personal data and your choices. By using the Services, you acknowledge our data practices and agree to review the Privacy Policy before using the Services.
6) Acceptable Use & Prohibited Conduct
You agree not to:
- Violate laws, MLS rules, or fair housing regulations.
- Upload unlawful, infringing, defamatory, deceptive, or misleading content.
- Share spam, advertisements, or solicitations unrelated to selling your property.
- Impersonate others or misrepresent your affiliation.
- Copy, scrape, crawl, or reverse-engineer the Services (except to the extent such restrictions are prohibited by law).
- Introduce malware or interfere with Service operation or security.
- Access non-public areas of the Services or attempt to circumvent access controls.
We may remove content or suspend/terminate access for violations.
7) User Content & License
Your Content. You retain rights to content you submit (e.g., property details, photos, videos, messages, documents). You represent you have all rights necessary to submit it and that it is accurate and lawful.
License to Loqol. You grant Loqol a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, use, reproduce, modify (for formatting/technical purposes), publish, display, distribute, and create derivative works from your content to operate, market, and improve the Services (including MLS and portal syndication, search results, caching/CDNs, backups, and promotional displays of your active listing). This license survives to the extent copies persist in technical systems or third-party caches consistent with industry practice.
Feedback. If you provide suggestions or feedback, we may use them without restriction or compensation.
8) Real-Estate Disclosures, MLS, and Third-Party Services
MLS & Portal Syndication. Where available, Loqol (or its brokerage partners) may submit listings to applicable Multiple Listing Services and portals (e.g., Zillow/Redfin/Realtor.com). Syndication destinations, timing, and display are controlled by those third parties and/or the MLS and are not guaranteed. You must review and approve your listing before publication.
Documents & Disclosures. The Services may help you prepare real-estate documents and disclosures based on your inputs and regional templates. You are solely responsible for the accuracy and completeness of your disclosures and documents. Loqol is not a law firm and does not provide legal advice.
Vendors & Referrals. The Services may suggest third-party vendors (e.g., photographers, stagers, inspectors, title/escrow) and may receive referral fees where permitted by law. Vendors are independent; Loqol does not warrant their services. You are responsible for due diligence and for entering any vendor contracts.
Buyer Screening & Communications. Loqol may filter spam and attempt to qualify inbound inquiries, but we do not guarantee buyer quality, financing, or closing outcomes.
9) AI-Enabled Features
The Services include AI features (e.g., conversational intake, document assistance, price positioning aids). AI outputs may be incorrect, incomplete, or not current. AI is provided for informational and workflow assistance only and is not a substitute for licensed legal, tax, or professional advice. You should verify critical information and consult qualified professionals as needed.
10) Intellectual Property
The Services, including software, text, designs, logos, and other content, are owned by Loqol or its licensors and protected by intellectual-property laws. Except for rights expressly granted, no license is granted. You may not use Loqol’s trademarks without our prior written permission.
11) Third-Party Content, Links, & Software
The Services may link to or rely on third-party sites, data, and software (including MLSs, portals, payment processors, messaging platforms). Loqol is not responsible for third-party content, availability, or practices. Your use of third-party offerings may be subject to their terms and privacy policies.
12) Takedown Policy & Copyright Complaints
We may remove content upon receiving a proper notice that it is infringing or otherwise violates law or our policies. If you believe content infringes your copyright, send a notice containing all required elements under 17 U.S.C. §512(c)(3) to [legal@loqol.ai] (or the address in Section 19). If you knowingly misrepresent that material or activity is infringing, you may be liable for damages.
13) NO WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOQOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT: (a) MLS/portal display or timing; (b) purchase offers, closing, or pricing outcomes; (c) AI output accuracy; or (d) uninterrupted, secure, or error-free operation.
No Legal/Financial Advice. The Services are not legal, tax, or financial advice. Consult your own attorney, tax advisor, and other professionals.
14) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOQOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED USD $20.00 or the amount you paid to Loqol for the Service that gave rise to the claim in the 3 months preceding the claim—whichever is greater. Some jurisdictions do not allow certain limitations; some limits may not apply to you.
15) Indemnity
You will indemnify and hold harmless Loqol from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your content or listings; (c) your violation of these Terms, laws, or third-party rights; or (d) your real-estate transaction(s).
16) Suspension, Changes, and Termination
We may modify, suspend, or discontinue any Service (in whole or part) at any time. You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, laws, or policies, or if required by law or MLS/partner rules. Sections that by their nature should survive (including 7–15, 17–20) will survive termination.
We are not obligated to store or return your content after termination, except as required by law or our Privacy Policy.
17) Export Controls
You agree to comply with U.S. and international export/import laws and sanctions. You represent you are not located in, or a national of, a sanctioned country or listed on a restricted parties list.
18) Governing Law; Dispute Resolution
Governing Law. These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.
Arbitration. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures before a single arbitrator in San Francisco County, California. Judgment on the award may be entered in any court of competent jurisdiction. No class or representative actions. Each party waives punitive/exemplary damages to the extent permitted by law. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in court for intellectual-property or confidentiality matters.
19) Notices
You agree that notices we provide electronically (via the Services or email) satisfy legal notice requirements. Legal notices to Loqol must be sent to:

Notices are deemed given: (i) when delivered personally; (ii) three business days after being sent by commercial overnight carrier with proof of delivery; or (iii) five business days after certified mail, postage prepaid, return receipt requested.
20) General Terms
These Terms (plus any applicable supplemental terms presented for specific features—e.g., MLS listing agreements, payment terms, referral program rules) are the entire agreement between you and Loqol regarding the Services and supersede prior agreements. If a provision is found unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign to an affiliate or acquirer. There are no third-party beneficiaries.
